Kickers - "Colour me in to win" Competition (the “Competition”)
- Terms and Conditions
- The Competition commences on 1 May 2010 (the “Opening Date”) and the closing date for entries is 5pm on 31 May 2010 (the “Closing Date”).
- The Competition is open to all residents of UK and Republic of Ireland. Entrants under the age of 16 must seek permission from a parent or guardian before entering the Competition.
- To enter the Competition, entrants must submit their “Colour Me in to Win” design (the “Design”) by one of the methods set out in clause [4] to these Terms and Conditions. Each submission will constitute one entry (the “Entry”).
- The Entries must be submitted by the entrant colouring in a picture of one of four styles of Kickers’ Lego® shoes available on www.colourmeintowin.com (the “Website”) or via rich media display banners available on various third party websites; completing the required entry details; and submitting the Entry following the online instructions. No purchase is necessary.
- Entries received before the Opening Date or after the Closing Date will not be eligible for the Competition. No other offers are available in conjunction with this Competition.
- A list of ten Entries will be selected as finalists by a panel of judges on or within 7 days of the Closing Date. The judges will apply the following judging criteria: creativity; originality; use of colour; and relevance to the Kickers and Lego® brand.
- The judging panel for the ten finalist Entries will include at least one person who is not an employee of Kickers. The adjudication process will be held in private. The names of those comprising the judging panel will be made available to Competition entrants on request. The judging panel’s decision is final and no correspondence will be entered into.
- The ten finalist Entries will be published on the Website on or within 7 days of the Closing Date for the general public to vote for an ultimate Competition winner. Each internet user will have one vote. The public vote will be open until 5pm on 30 June 2010 (the “Final Closing Date”). The Design with the most votes will be announced as the winner (the “Prize Winner”) on the Website on or within 7 days of the Final Closing Date. No correspondence will be entered into concerning the result and Kicker’s decision is final.
- The Prizes consist of one First Prize and nine Runner’s Up Prizes for the remaining finalists.
- The Prize Winner will win the First Prize, which is a pair of Kickers shoes bearing their winning Design in the size and style specified in their Entry. The Prize Winner’s Design may also be incorporated into one of Kicker’s SS11 footwear styles. Notwithstanding the winning Design selected by the general public and the Prize awarded to the Prize Winner, Kickers reserves the right ultimately not to use the Design selected within the framework of the Competition on any of Kickers’ footwear styles.
- The remaining nine finalists will each win a Runner’s Up Prize, which is a pair of standard Kickers Lego® shoes in the size and style specified in their respective Entries.
- A rights assignment document must be signed by the Prize Winner which is an integral condition for the Prize Winner’s Design winning the Competition. The Prize Winner must execute an assignment of the copyright any all other rights subsisting in the Design in favour of Kickers within 14 days of the Final Closing Date or within 14 days of being contacted by Kickers pursuant to clause 19 below, whichever is the later. In the event the Prize Winner does not execute such an assignment, Kickers reserves the right to offer the First Prize to the next eligible Entry selected by the judging panel and thereafter until a winner is found.
- Where the Prize Winner is under 16 and they enter into a rights assignment, the Prize Winner shall obtain the consent of their parent or guardian who shall in turn be party to the assignment as guarantor and agree to procure the Prize Winner’s performance of the assignment and to indemnify Kickers for any breach of the assignment.
- The First Prize should be delivered to the Prize Winner within 8 weeks of the execution of the rights assignment by the Prize Winner (and their parent or guardian where necessary). The Runner’s Up Prizes should be delivered to the nine finalists within 8 weeks of the Final Closing Date. Kickers will be responsible for the costs of postage and packing, however delivery within this time scale is not guaranteed.
- By submitting an Entry, the entrant (and, if under 16, the entrant’s parent or guardian) warrants that the Design is original and the entrant’s sole creation. The Design must not be subject to any copyright, trademark, other intellectual property right or any previous use of the entrant or a third party.
- All Entries, Designs and any rights, titles or interests attaching thereto shall automatically become the property of Kickers. Entries will not be returned. By entering the Competition, entrants irrevocably grant and assign to Kickers, and agree to execute all necessary documents to give effect to the same, all intellectual property and other proprietary rights in the Design(s) and agree specifically to Kickers’ using the Design(s) for Kickers’ own purposes in all activities including, without limitation, marketing, promotion, distribution and sale worldwide as Kickers sees fit, without any further payment or acknowledgement to the Competition entrant. By entering the Competition, entrants irrevocably waive any and all moral right subsisting in the Designs.
- Design which are deemed, in Kicker’s sole opinion, to contain offensive or inappropriate content, or which Kickers otherwise considers unsuitable for the Competition, will be void. In the unlikely event that Kickers receives duplicate or otherwise indistinguishable Entries, the Design received first will be valid; all other duplicate Entries will be void.
- The First Prize and Runner’s Up Prizes, or part thereof, are all subject to availability and may be altered or varied at Kickers’ sole discretion and substituted with a prize which, in Kickers’ sole opinion, is a suitable alternative. All Prizes are non-negotiable, non-transferable, non-returnable and there is no cash alternative. The Prizes may not be transferred, sold, offered for sale, coupled or bundled with any other product or service or used for any commercial or promotional purposes whatsoever without the consent of Kickers.
- The Prize Winner and the nine finalists will be contacted by telephone or email within 10 days of the Final Closing Date. If they cannot be contacted during this period, Kickers reserves the right to allow the Prizes to lapse or to offer the Prize(s) to the next eligible Entry selected by the judging panel and thereafter until a winner is found.
- By entering the Competition, entrants agree that their details may be used in future marketing activity of Kickers and that their details may be disclosed to anyone requesting details of the finalists and/or the Prize Winner. The finalists and/or the Prize Winner may also be required to take part in any publicity relating to this Competition.
- Details of the finalists’ names and home counties will be made available after the Closing Date for 28 days to those sending a stamped and self-addressed envelope to Kickers Colour Me In To Win Competition, The Pentland Centre, Squires Lane, London N3 2QL.
- Information and data which is provided by entrants will be held and used by Kickers in order to administer the Competition. The information will not be used for any purpose other than as stated in these Terms & Conditions or as separately accepted by the entrants. Any personal data that entrants provide will be held and processed in accordance with the Data Protection Act 1998.
- Entry into the Competition will constitute acceptance of these Terms and Conditions and any separate instructions for entry will form part of these Terms and Conditions. Any Entry which does not comply with the entry instructions shall be invalid.
- Employees of Kickers, its associated companies, advertising and marketing consultants, agents and anyone connected with the Competition and their families are not eligible to enter the Competition.
- Kickers do not accept any responsibility for any network congestion, technical failure, clerical or other error which may result in any Entry not being properly recorded or received.
- Kickers reserves the right to withdraw or amend the Prizes, Competition and/or these Terms and Conditions in the event of any unforeseen circumstances outside its reasonable control or if, in its absolute discretion, Kickers deems it necessary. Kickers shall not be liable in the event that the Competition or Prizes, or part thereof, are altered or cancelled for any reason.
- To the maximum extent permitted by law, Kickers, its associated companies, advertising and marketing consultants, agents and anyone connected with the Competition shall not be liable for any claims or actions of any kind whatsoever for damages or losses to persons or property which may be sustained in connection with Kickers’ use of the Designs or the finalists’ receipt, ownership and/or use of the Prize(s).
